 《女职工劳动保护特别规定》第7条规定:“女职工生育享受98天产假,其中产前可以休假15天;难产的,增加产假15天;生育多胞胎的,每多生育1个婴儿,增加产假15天。女职工怀孕未满4个月流产的,享受15天产假;怀孕满4个月流产的,享受42天产假。”  《中华人民共和国劳动合同法》第4条第1款规定:“用人单位应当依法建立和完善劳动规章制度,保障劳动者享有劳动权利、履行劳动义务。”  《中华人民共和国劳动合同法》第48条规定:“用人单位违反本法规定解除劳动合同的,劳动者要求继续履行劳动合同的,用人单位应当继续履行;劳动者不要求继续履行劳动合同或者劳动合同已不能继续履行的,用人单位应当依照本法第八十七条规定支付赔偿金。”  作为用人单位应当严格遵守劳动法律的规定,对处于怀孕期、产期、哺乳期的“三期”女职工的劳动管理应多一些“温情”和“厚待”。《劳动法》、《劳动合同法》、《妇女权益保障法》、《女职工劳动保护特别规定》均规定了女职工在“三期”期间所应享有的权利。用人单位应为“三期”女职工提供合适强度的工作岗位和安全的工作环境,不得随意降低“三期”女职工的工资待遇,也不得随意解除劳动合同。作为“三期”女职工也应当遵守劳动法律法规和单位的规章制度,这样才能构建和谐的劳动关系,减少劳动纠纷的发生。  相关阅读:  (一)《女职工劳动保护规定》  第4条规定:“不得在女职工怀孕期、产期、哺乳期降低其基本工资,或者解除劳动合同。”  第7条规定:“怀孕的女职工,在劳动时间内进行产前检查,应当算作劳动时间。”  (二)《企业职工生育保险试行办法》的规定,女员工产假期间的生育津贴按照本企业上年度职工月平均工资计发,由生育保险基金支付。  (三)《妇女权益保障法》  第二十七条:任何单位不得因结婚、怀孕、产假、哺乳等情形,降低女职工的工资,辞退女职工,单方解除劳动(聘用)合同或者服务协议。但是,女职工要求终止劳动(聘用)合同或者服务协议的除外。  (四)《劳动部关于女职工生育待遇若干问题的通知》  一、女职工怀孕不满四个月流产时,应当根据医务部门的意见,给予十五天至三十天的产假;怀孕满四个月以上流产时,给予四十二天产假。产假期间,工资照发。  二、女职工怀孕,在本单位的医疗机构或者指定的医疗机构检查和分娩时,其检查费、接生费、手术费、住院费和药费由所在单位负担,费用由原医疗经费渠道开支。
