AbstractGeographicalIndication(CalledGI)isoneoftheimportantIntellectualPropertyRights.ForrichandwideChina,ItisverymeaningfultoperfecttherelatedworkonGI.SinceChinajoinedtheWTO,inordertoprotecttheIntellectualPropertyRightandmeettheobligationofTRIPS,wetookpositiveprotectiononGI.However,westartedlateinprotectionofGIandwehaveanimperfectlegislation.Fornow,thereexistthreekindsofGIinourcountry,includingGIprotectedbySAICofthePRCintheformofcollectivemarksandcertificationmarks,GIproductsauthorizedbyTheAQSIQofPRCandagri-productregisteredinMOAofPRC.AllthreeareknownasGI.ButforthereasonofconfusedmanagementanddifferentstandardofGI,inpractice,thereexistsalotofdisharmonyespeciallyinlawconflictsbetweenGIandTrademarksofGeographicalNames(CalledTGN).Thereforethisthesistriedtostudytheconcreterepresentations,reasonsandsolutionsofthiskindofconflictbyusingofcaseanalyticalmethod.Itincludesfiveparts:Thefirstpartisanintroductionoftwotypicalcasesas―QinzhouYellowCase‖and―Dong’eDonkey-hidegelatinCase‖.AuthorwillinducethefocusofthetwocaseswhichmainlyreflecttheconflictbetweenGIandTGN.Inthefirstcase,―Qinzhou‖belongstoTGNand―QinzhouYellow‖isauthenticatedasGIproduct.Thecomplainantrequestedtoconfirmhisrighttouse―QinzhouYellow‖onhismilletproductbynon-trademarkform.Thecourtfinallyascertainedthatthecomplainant’sactionislegal.ThesecondcasemainlyinvolvedtheGIconflictamongdifferententerprises,includingGIconflictbetween―Dong’etown‖and―Dong’ecounty‖andconflictbetween―Dong’e‖GIand―Dong’eTGN‖.Thesecondpartmainlyintroducestheconcept,valueanddifferencebetweenGIandTGN.Bothofthemiskindofcommercialsign.ThoughthereexistsnumberofcommongroundbetweenGIandTGN,theyhavediversitiesbythemselves.Onlywhenwedistinguishtheirnaturewitheachother,canwesolvetheconflictbetweenthem.ThethirdpartintroducestheconcreterepresentationsandreasonsoftheconflictbetweenGIandTGN.Theconflictperformsinthreeaspects:conflictofadvancedGI1andlatterTGN,conflictofadvancedTGNandlatterGIandGIconflictamongdifferentdepartment.Conflictresultsfromfourreasons,inc
