美国的Exclusivity Expiration一般比Patent Expiration短，那Exclusivity Expiration有什么意义？
Exclusivity是美国FDA（美国食品药品管理局）授权的。Exclusivity Expiration是该授权过期时间，一般是半年到7年，Exclusivity主要有以下几种：
Orphan Drug (ODE) - 7 years
New Chemical (NCE)- 5 years
"Other" Exclusivity - 3 years&&for a "change" if criteria are met
Pediatric Exclusivity (PED) - 6 months added to existing Patents/Exclusivity
Patent Challenge – (PC) – 180 days (this exclusivity is for ANDAs only)
从上面可以看出，虽然孤儿药和新化学实体这两项的专营权效期比专利期短。但儿科用药是在专利期的基础上再加6个月，而专利挑战成功（针对仿制药）的也可获得为期180天的专营权。
此外，有些药品并没有化合物专利来保护，因此这一项专营权也是很重要的。
总之，FDA的专营权是对美国法律体系的一个重要补充，它的存在可以使FDA以及美国联邦政府对医药市场进行一定的倾斜和调控。

专利是可以挑战的，一旦成功，药品就不受保护了，可是这个时候如果FDA一旦授予有垄断权，就算挑战成功，还是不可以销售的。
另一方面，专利是有地域限制的，如果这个药物在其他国家2020年到期，可能在美国2018年就到期了。这时候美国市场垄断权2019年到期，那么就意味着在美国市场还能多销售一年。所以你看到专利到期，一定要注意看看是在那个国家到期。
